Deferred action has certain eligibility criteria as well. According to Deferred action, children above 15 years and below 31 years can defer his removal procedure due to non-immigration status for 2 years, which can be further renewed. Please note that Deferred Action is no way paves way for your citizenship or legal existence. It is more of a legal status-quo unchanged for illegal immigrants. After the act is approved in an individual’s case, he/she can apply for work authorization as well.

The eligibility criteria are as such:

1)      Came to US under 16 years of age AND has completed 5 years of his continuous stay till June 12, 2012 (When memorandum was issued).

2)      Has entered US before 15th June, 2012 (illegally without inspection) or his visa expired before 15th June, 2012.

3)      Present on 15th June, 2012 and also at the time of applying for deferred action.

4)      Currently engaged in schooling or completed high school. Also valid if general education development (GED) certificate is possessed or has graduated.

5)      Honorably discharged veteran of armed force or coast guard (US).

6)      Does not possess significant misdemeanor record, threat to national security, convicted of felony, and 3 or more misdemeanors

 

The person needs to be below 31 years of age as of 15th June, 2012 also. Also, if child is below 15 years and currently undergoing removal procedure or have been issued final removal order or otherwise having voluntary departure order can also submit their request to USCIS (US Customs and Immigration Enforcement). The no. of applicants approved for deferred act is about 300,000, till May 2013 and estimated illegal immigrants are about 11 million throughout US.

 

People applying for DACA require no sort of legal representatives, they simply need to submit mainly 2 forms (plus a worksheet) along with a $465 application fee:

·         Application for DACA (Form no. : I-821D)

·         Application for Employment authorization (Form no. : I-765D) and Worksheet associated with it (Form no. : I-765WS)

Along with these forms, you will also be required to legible proofs to support the continuous stay and criteria laid down for you to qualify for DACA
